Sentimentick is an informational research platform for market sentiment, narrative tracking, and source-backed context. These Terms explain how you may use the Service and important limitations on data, alerts, and analytical outputs.

1. Introduction and Acceptance of Terms
These Terms of Use ("Terms") govern access to and use of the Sentimentick website, applications, dashboards, alerts, application programming interfaces ("API"), and related services (collectively, the "Service") operated by Sentimentick, Inc. ("Sentimentick," "we," "us," or "our").
By accessing, registering for, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.
2. Description of Service
Sentimentick is a software-as-a-service platform that provides informational tools for monitoring public market conversation, ticker attention metrics, sentiment indicators, market narratives, source-backed context, watchlists, alerts, and related analytics.
Depending on your plan (Basic, Pro, Enterprise, or other offerings we make available), you may receive varying levels of access to dashboards, search and filter tools, narrative detail views, evidence or source references, alert configuration, API access, usage quotas, and administrative features.
The Service is provided for informational, educational, and research purposes only. It is intended to help users observe how public discussion, news, and related sources may relate to securities and market themes. It is not a substitute for independent judgment, professional advice, or direct verification of underlying sources.
Sentimentick does not execute trades, hold customer funds, clear transactions, or operate as a marketplace for securities.
3. No Financial Advice; No Investment Recommendations
SENTIMENTICK DOES NOT PROVIDE FINANCIAL, INVESTMENT, TRADING, LEGAL, TAX, ACCOUNTING, OR OTHER PROFESSIONAL ADVICE.
Nothing on the Service—including sentiment scores, narrative rankings, attention metrics, heat or acceleration measures, summaries, briefs, watchlists, alerts, evidence feeds, charts, exports, or API outputs—constitutes a recommendation, solicitation, or offer to buy, sell, hold, short, or otherwise transact in any security, derivative, cryptocurrency, exchange-traded fund, option, or other financial instrument.
- Sentiment indicators and attention metrics reflect analytical processing of available sources; they are not trade instructions.
- Market narratives describe themes observed in public discussion; they may be incomplete, contested, or wrong.
- Alerts and notifications are informational notices only; delivery does not imply that any action is appropriate for you.
- Source-backed context is provided for research transparency; we do not warrant the accuracy or fairness of underlying third-party content.
You are solely responsible for your own investment and trading decisions. You should consult a qualified, licensed professional adviser before making financial decisions. Sentimentick does not consider your personal financial situation, investment objectives, risk tolerance, time horizon, liquidity needs, tax status, regulatory constraints, or existing portfolio.
4. Not an Investment Adviser, Broker-Dealer, or Trading Venue
Sentimentick is not registered or licensed as an investment adviser, broker-dealer, municipal securities dealer, government securities broker or dealer, securities exchange, alternative trading system, transfer agent, clearing agency, futures commission merchant, commodity trading adviser, commodity pool operator, rating agency, or similar regulated financial entity in any jurisdiction, and nothing in the Service should be interpreted as implying such status.
- We do not provide individualized investment advice or portfolio recommendations tailored to you.
- We do not solicit or effect securities transactions on your behalf.
- We do not receive transaction-based compensation for recommending or effecting trades in any specific security.
- We do not custody assets, manage money, or provide personalized suitability analysis.
5. Market Data, Sentiment Data, and Source Limitations
The Service may incorporate or reference public sources, licensed or third-party market data, news, social discussion, filings, and other materials. All such information is subject to material limitations.
- Data may be delayed, incomplete, inaccurate, mislabeled, duplicated, or temporarily unavailable.
- Public-source content may include rumors, speculation, humor, sarcasm, promotional material, bot activity, spam, coordinated campaigns, or biased opinions.
- Ticker symbols and company names may be ambiguous; automated processing may associate content with the wrong issuer.
- Sentiment and narrative classifications may be wrong, stale, or misleading in fast-moving markets.
- Scores and rankings can change quickly and may differ materially from other methodologies.
- Past sentiment, attention, or narrative movement does not predict future price performance or investment results.
Sentimentick does not guarantee the accuracy, completeness, timeliness, merchantability for your use case, or continuous availability of any data or analytical output.
6. Automated and Algorithmic Analysis
Some Service outputs may be generated, assisted, ranked, summarized, clustered, scored, or classified using automated systems, including machine-learning or other algorithmic methods.
- Automated systems may misunderstand context, sarcasm, irony, cultural nuance, financial terminology, or source reliability.
- Summaries and briefs may omit material facts or overemphasize volatile discussion.
- Scoring formulas, models, data pipelines, source weighting, and classification rules may change without notice.
- Outputs should be independently verified before you rely on them for any decision.
Sentimentick does not represent that automated outputs will improve your investment results, reduce risk, or produce any particular research outcome.
7. No Guarantees; Market Risk
Sentimentick does not guarantee profits, trading success, alpha, market outperformance, loss avoidance, alert timeliness, data continuity, or any other financial or operational outcome.
Investing and trading involve substantial risk, including the possible loss of principal. You assume all risk associated with decisions you make using, or in connection with, information from the Service.
8. User Responsibilities
You agree that you will:
- Not rely solely on the Service for investment or trading decisions.
- Not treat alerts, scores, or rankings as instructions to enter or exit positions.
- Evaluate information independently and verify material facts through primary sources where appropriate.
- Comply with all laws and regulations applicable to your access and use of the Service.
- Maintain the confidentiality of your account credentials and API keys.
- Promptly notify us of suspected unauthorized access.
- Use the API and other programmatic access only as permitted by your plan and these Terms.
- Not scrape, harvest, or systematically extract Service data except through authorized API access where included in your plan.
9. Account Registration and Security
- You must provide accurate, current registration information and keep it updated.
- You are responsible for all activity under your account and for safeguarding passwords and API credentials.
- You must not share credentials in a manner that violates your plan or these Terms.
- We may suspend or terminate accounts that present security, legal, abuse, or non-payment risk.
10. Plans, Billing, and Subscriptions
Basic, Pro, Enterprise, and other plans may include different feature access, usage quotas, rate limits, and support levels as described on our website or in an order form.
- Paid subscriptions renew automatically for the selected billing period unless canceled in accordance with applicable billing flows.
- Fees, features, and quotas may change upon reasonable notice where required by law or contract.
- Enterprise customers may be subject to a separate written agreement that controls in the event of conflict.

11. API Terms
API access is available only where included in your subscription or separate written agreement.

- We may monitor usage, modify endpoints, and suspend or revoke API keys for misuse or security concerns.
12. Alerts and Notifications
Alerts and notifications are informational only. They may be delayed, duplicated, missed, filtered, or unavailable due to technical, source, or configuration limitations.
Alerts are not trade instructions. You remain solely responsible for evaluating whether any action is appropriate.
13. Intellectual Property
Sentimentick owns or licenses the Service, including software, design, user interface, scoring systems, analytics, models, documentation, trademarks, and proprietary content, subject to third-party rights in underlying source materials.
Subject to these Terms and your plan, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for your internal research purposes. You may not copy, modify, distribute, sell, lease, reverse engineer, or create competing products or datasets from the Service except as expressly permitted.
14. Third-Party Content Sources & Attribution
The Service aggregates publicly available financial news, market commentary, and community discussion content from third-party platforms and publications, including but not limited to Yahoo Finance, MarketWatch, CNBC, CNN Business, Seeking Alpha, Benzinga, and Reddit. This aggregation is performed for informational research purposes only.
All third-party content displayed on the Service is subject to the following terms:
- Copyright Ownership: All rights, title, and interest in third-party content remain with the respective copyright holders. Sentimentick makes no claim of ownership over any third-party content.
- Attribution: Each evidence item displayed includes a copyright attribution notice (e.g. "© MarketWatch, Inc. / Dow Jones & Company") and a direct link to the original source.
- Fair Use: Content is displayed as short excerpts only, consistent with fair use principles under 17 U.S.C. § 107 for purposes of commentary, research, and informational aggregation. Sentimentick does not store or display full article text.
- Author Anonymization: For user-generated content (e.g. Reddit posts), individual author usernames or handles are never stored or displayed. Community content is attributed collectively to the platform (e.g. "Reddit Community") in compliance with applicable privacy laws.
- No Endorsement: References to or display of third-party content does not constitute endorsement, sponsorship, or affiliation with those publishers or platforms.
Copyright Dispute Contact: If you are a rights holder and believe that content is displayed outside the scope of fair use, please contact us at contact@sentimentic.com with (i) your name and contact information, (ii) identification of the copyrighted work claimed, (iii) identification of the material on our Service, and (iv) a statement that you have a good faith belief the use is unauthorized. We will investigate and respond promptly.
15. Feedback and User Content
If you submit feedback, suggestions, or other content through the Service, you grant Sentimentick a perpetual, worldwide, royalty-free license to use that material to operate, improve, and promote the Service without obligation to you, except where prohibited by law.
Do not submit confidential or proprietary information through general feedback channels unless covered by a separate written agreement.
16. Privacy
Your use of the Service is also subject to our Privacy Policy, which describes how we collect, use, and protect personal information. If there is a conflict between these Terms and the Privacy Policy regarding data practices, the Privacy Policy controls for privacy matters.

17. Prohibited Uses
You may not use the Service to:
- Violate applicable law or regulation.
- Manipulate markets or disseminate deceptive financial promotions.
- Misrepresent Sentimentick outputs as personalized investment advice or guaranteed trade signals.
- Redistribute data, benchmarks, or derived datasets without authorization.
- Interfere with Service integrity, authentication, or rate limits.
- Reverse engineer or attempt to extract source code or models except where legally permitted.
- Train competing models or commercial datasets using Service outputs without written permission.
- Access the Service through unauthorized automated means outside permitted API use.
18. Service Availability and Changes
The Service may be unavailable, interrupted, delayed, or modified at any time for maintenance, security, capacity, product, or legal reasons. We may add, remove, or change features, sources, scoring methodologies, or plan limits without liability for resulting unavailability of prior functionality.
19. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENTIMENTICK DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION.
We do not warrant that the Service will meet your requirements, produce any investment result, or be error-free.
20. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENTIMENTICK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR INVESTMENT LOSSES, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.
Our aggregate liability for claims arising out of or relating to the Service will not exceed the greater of (a) amounts you paid to Sentimentick for the Service in the twelve (12) months before the event giving rise to the claim, or (b) [Insert liability cap after legal review].
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
21. Indemnification
You agree to defend, indemnify, and hold harmless Sentimentick and its affiliates, officers, directors, employees, agents, and licensors from claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of law, or your misuse of data or API access.
22. Suspension and Termination
We may suspend or terminate your access immediately for violation of these Terms, suspected fraud or abuse, non-payment, security risk, legal requirement, or harm to the Service or other users. You may stop using the Service at any time.
Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.
